1. General Information
These Terms of Sale govern the purchase of fine art prints and related products through https://danielsimion.ro.
The Seller is Simion Florin Daniel PFA, registered with the Romanian Trade Register under no. F2025 031 129 005, Unique Registration Code (CUI): 52 387 245, with registered office in Balotesti, Ilfov, Romania, trading as Daniel Simion Photography.

By placing an order, you agree to be bound by these terms.
2. Product Nature: Print-on-Demand
All artworks offered on this website are custom-made products. We do not maintain inventory. Each print is produced individually upon order by our production partner, WhiteWall GmbH (Germany), according to the size, material, and finishing options selected by the customer.
3. Orders and Contract Conclusion
The presentation of products on the website constitutes a non-binding invitation to treat.
By placing an order, you submit a binding offer to purchase the selected artwork. The contract is formed when we send an order confirmation via email.
We reserve the right to refuse or cancel orders in justified cases, including payment verification failure.
4. Pricing, VAT Status, and Import Duties
The prices displayed on the website represent the final price of the artwork.
VAT Status:
The Seller operates under the Romanian Special Exemption Scheme for Small Enterprises (Art. 310 Romanian Fiscal Code). VAT is not applicable and is not added to the checkout price.
International Orders (Non-EU):
For customers located outside the European Union (including the United Kingdom and the United States), goods are shipped from Germany. Orders may be subject to customs duties, import taxes, or administrative fees imposed by the destination country. Such charges are strictly the responsibility of the buyer.
If a package is returned due to unpaid customs duties or refusal to accept delivery, the Seller reserves the right to withhold any refund, as the goods are custom-made and cannot be resold.
5. Payment
Payment must be made in full at the time of order. Payments are processed securely via Stripe and PayPal. The Seller does not store or process payment card details.
6. Delivery and Risk Transfer
Delivery times are estimates and may vary depending on production complexity and destination country. Risk of loss or damage passes to the buyer when the goods are delivered to the buyer or to a third party designated by the buyer.
7. Right of Withdrawal
In accordance with Article 16© of Directive 2011/83/EU and corresponding UK consumer legislation, the statutory right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalized.
As each artwork is produced on demand, orders are final once production has commenced.
This exclusion applies exclusively to personalized, made-to-order artworks. If non-personalized goods are offered in the future, statutory withdrawal rights will apply as required by law.
8. Damaged or Defective Goods
The buyer must inspect the artwork immediately upon delivery.
Any visible damage must be reported within 48 hours, accompanied by clear photographic evidence of both packaging and artwork.
Minor variations in color, tone, or finish resulting from differences between digital displays and professional printing processes are inherent characteristics of fine art production and do not constitute defects.
Where a manufacturing defect is confirmed, the Seller’s obligation is limited to replacement. Refunds are issued only if replacement is not reasonably possible.
9. Force Majeure
The Seller shall not be liable for delays or failure to perform resulting from events beyond reasonable control, including but not limited to natural disasters, war, transportation disruptions, supply chain interruptions, governmental actions, or other unforeseen circumstances.
10. Intellectual Property
The purchase of a print confers ownership of the physical object only.
All copyright and intellectual property rights in the image remain exclusively with Simion Florinn Daniel PFA. Reproduction, scanning, distribution, or commercial use without prior written consent is prohibited.
11. Online Dispute Resolution (EU)
In accordance with EU Regulation No. 524/2013, consumers may access the European Online Dispute Resolution platform at:

12. Governing Law
These Terms are governed by Romanian law. However, this choice of law does not deprive consumers of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence.
